Terms of Use
No Attorney-Client Relationship Created by Use of This Website
Neither your receipt of information from this Website nor your use of this Website to contact Trademark 360 Corp. (“TM360”) creates an attorney-client relationship. TM360 does not accept new clients without first checking for potential conflicts of interest and obtaining a signed engagement letter. Accordingly, you should not use this Website to provide confidential information.
Attorney Advertising
This Website may constitute attorney advertising. The practice summaries and attorney biography on this Website may describe results obtained in matters handled for TM360’s clients. These descriptions are intended only to provide information about the activities and experience of TM360 and are not intended as a guarantee that the same or similar results can be obtained in other matters. The result of any case depends on a variety of factors, including the specific facts and legal issues involved, the ability of opposing counsel, and often, unexpected developments beyond the control of any client or attorney.
No Legal Advice Intended
This Website includes information about legal issues and developments for general informational purposes only and may not reflect the most current legal developments. These materials are not intended to be, and should not be construed as, legal advice on any particular set of facts or circumstances. You should contact TM360 directly for legal advice regarding your specific situation.
Authorized Practice of Law
Attorneys at TM360 are licensed to practice law in the State of New York, and TM360 expressly disclaims all liability in connection with actions taken or not taken based on any content on this Website. The ability of TM360 to engage in legal services on behalf of a client outside an attorney’s state of licensure is governed by state statutes, professional codes, and court rules. However, trademark law is federal in nature, and pursuant to the rules of the United States Patent and Trademark Office (USPTO), attorneys who are licensed and in good standing in any U.S. state or territory are authorized to represent clients in trademark matters before the USPTO, regardless of the attorney’s or client’s physical location. TM360 does not seek, and this Website is not intended to solicit, legal engagements in jurisdictions where such activity would constitute the unauthorized practice of law.
Confidentiality & Conflicts
TM360 will maintain the confidentiality of all information it receives in connection with any matter in accordance with its usual procedures. TM360 will not disclose any such information to another person unless: (i) the information is already publicly available; (ii) the information becomes available on a non-confidential basis through a third-party source; (iii) disclosure is required by applicable law, regulation, court, or administrative order; or (iv) the information is disclosed to other professional advisers or third parties for purposes of supporting our legal work.
If TM360 holds confidential information relating to other clients and owes a duty of confidentiality in respect of that information, we will not disclose it to you or use it for your benefit. Subject to applicable laws and regulations, you agree that TM360 may represent existing or future clients in matters that are or may become indirectly adverse to you or your interests. If any such representation constitutes a conflict of interest under the ethical rules of New York or other applicable jurisdictions, you hereby provide informed consent and waive any such conflict to the extent permitted by law. TM360 will process any personal data obtained in the course of our relationship in accordance with applicable data protection laws.
